The High Court began hearing the Ice TV appeal today before six justices (Justice Kirby didn’t sit). The hearing will continue tomorrow. The transcript of the first day of oral argument is already available on AustLII here …

Wow, check out the special leave transcript on Austlii! They’ve made it clear that this will be a root-and-branch re-examination of the law, with Gummow (Gummow!) expressing major skepticism about the UK cases and preferring the US ones, citing all manner of political views about the inappropriateness of dodgy applications of old copyright law to ‘electronic’ settings. Counsel were even given some required reading: Dr Deazley in [2004] Intellectual Property Quarterly 121. There is also what may be a useful article by Professor Sterk in Michigan Law Review for 1996, Volume 94, pp 1197 called Rhetoric and Reality in Copyright Law. ICE must be very happy.
